Abstract
Hukuk düzeni, şahısların maddi varlıklarını koruduğu gibi manevi varlıklarına, onur, şeref ve haysiyetlerine yapılacak saldırılara karşı da önlemler almıştır. Bu kapsamda Türk Ceza Kanunu’nda düzenlenen hakaret suçu ile kişilerin manevi bütünlüklerine yapılacak eylemler yaptırıma bağlanmıştır. Özellikle teknolojik gelişmelerin de etkisiyle söz konusu bu manevi bütünlüğe, internet ortamında da saldırı yapılabilmesi olası hâle gelmiştir. Bilişim sistemlerinin günümüz itibariyle muhtevası ve özellikle sosyal medya platformlarının politikaları nedeniyle bazı hâllerde hukuk tepkisiz kalabilmektedir. Devlet otoritesi bireylerin manevi bütünlüğünü korumaktan sorumludur. Bu durumun önüne geçmek ve kişilerin manevi bütünlüğüne yapılan saldırının karşılıksız kalmaması için, soruşturma evresinde delil tespitinde günümüz teknolojik gelişmelerine uygun bir araştırma ve tespit süreci gerekmektedir. Yaşanan teknolojik gelişmeler hakaret suçunun işlenmesini kolay kılmış olsa da tespitinde suçun uluslararası platformlarda da işlenebilmesi sebebiyle bazı noksanlıklar çıkartmaktadır. Bu durumda Ceza Kanunu ve Bilişim Suçları, hakaret suçunun soruşturma evresinde birlikte hareket ederek bireyin manevi bütünlüğünü korumaktadır. Fakat uluslararası platformlarda işlenen suçlarda, birtakım anlaşmaların ve suçun işlenmiş olduğu ülkede de değindiğimiz fiilin suç olup olmadığının değerlendirilmesi gerekmektedir.

Abstract
The legal order not only protects the material assets of individuals, but also takes precautions against attacks on their moral assets, honor and dignity. In this context, actions to be taken against the moral integrity of individuals with the offense of libel regulated in the TPC are sanctioned. Especially with the effect of technological developments, it has become possible to attack this spiritual integrity in the internet environment. Due to the content of information systems as of today and especially the policies of social media platforms, the law may remain unanswered in some cases. The state authority is responsible for protecting the moral integrity of individuals. In order to prevent this situation and to ensure that the attack on the moral integrity of individuals does not go unrequited, a research and detection process in accordance with today’s technological developments is required in the detection of evidence during the investigation phase. Although the technological developments have made it easy to commit the crime of insult, it creates some shortcomings in its detection as the crime can also be committed on international platforms. In this case, the Criminal Code and IT Crimes protect the moral integrity of the individual by acting together in the investigation phase of the crime of defamation. However, it is necessary to evaluate whether there are some agreements in crimes committed in international platforms and whether the act we mentioned in our study is a crime in the country where the crime was committed.
